• The Massachusetts State Legislature has amended the Homestead Laws. This has substantially increased the protection to homeowners. The protection under the Homestead Act has been increased to $300,000.00 of the equity in the home from future creditors' attachments, levy on execution and sale.
• Homesteads are now available to single as well as married homeowners, with or without children, provided that the home is the principal residence of the owner.
• In addition, there is an alternative Homestead exemption, if the owner of the principal residence is sixty-two (62) years of age or older, or is permanently and totally disabled, regardless of age. This exemption is for $300,000.00 for each qualified individual owner. This gives a total exemption of $600,000.00 for two owners i.e. Husband and wife.
